Terms of service
1. Who we are
The website www.racereels.com.au is operated by Race Reels PTY LTD, ABN 29 679 655 193, trading as Race Reels® (“Race Reels”, “we”, “us” or “our”).
Our website is hosted using Shopify. Shopify provides the e-commerce platform, but your contract for a Race Reels® purchase is with us, not Shopify.
2. Acceptance of these terms
By using this website, submitting an enquiry or placing an order with us, you agree to these Terms of Service and the policies referred to in them. If you place an order for a business or organisation, you confirm that you have authority to bind that organisation.
You must be at least 18 years old, or otherwise have legal capacity and authority, to place an order.
3. Product information
We take reasonable care to describe and display our products accurately. Product images are illustrative and colours may vary between screens. Packaging, minor finishes or non-material specifications may change as products are improved, provided the product remains materially consistent with its description and applicable law.
Any performance comparison, time-saving figure or demonstration should be read together with the test conditions, assumptions and explanations supplied with it. Actual results may vary with the operator, vehicle, load, environment, maintenance and work procedure.
4. Orders and contract formation
An order is an offer to purchase. A binding contract is formed when we accept the order, including by sending an order confirmation, issuing an accepted invoice or dispatching the goods. An automated acknowledgement does not necessarily mean the order has been accepted.
We may decline or cancel an order before dispatch for a legitimate reason, including stock unavailability, an obvious pricing or description error, suspected fraud, payment failure, an unsupported delivery address or a legal restriction. If we cancel after payment, we will refund the amount paid for the cancelled goods.
5. Pricing, GST and payment
Prices are shown in Australian dollars. Unless clearly stated otherwise, consumer-facing prices include GST. Delivery or other charges are shown before the order is submitted or set out in our quote or invoice.
Online orders must be paid using an available checkout method. Direct business orders may be paid by an approved method shown on our invoice. Any 7-day, 14-day or other credit terms apply only if Race Reels® approves them in writing before dispatch. Otherwise, payment is required before dispatch or collection.
You must provide accurate billing and payment information and must be authorised to use the chosen payment method. Payment providers may conduct fraud, identity and security checks under their own terms and privacy policies.
6. Purchase orders and business customers
A customer purchase order is used for ordering and administration. Any additional or different terms printed on a purchase order do not override these terms unless we expressly agree to them in writing. A quote is valid for the period stated on it and may be withdrawn before acceptance.
Nothing in this section excludes any Australian Consumer Law protection that applies to a business purchase.
7. Delivery and collection
Delivery and collection are governed by our Shipping Policy and the delivery information shown at checkout, in a quote or on an invoice. Delivery dates are estimates unless we expressly agree otherwise in writing.
You must provide a complete and accessible delivery address and arrange a person or authority to receive the goods where required. Additional costs caused by an incorrect address, refused delivery or failed delivery may be charged where lawful and reasonably incurred.
Risk in the goods passes to you on delivery to the nominated address, collection by you or your representative, or delivery to a carrier you separately nominate, subject to applicable law.
8. Safe selection, installation and use
Race Reels® products are load-restraint equipment. Correct equipment selection and use depend on the vehicle, load, working conditions and applicable laws and procedures.
Read and follow all product instructions, labels, warnings and rated capacity information.
Inspect the complete system before each use and remove damaged, worn, contaminated or suspect equipment from service.
Do not modify the product or use it for lifting, towing, personnel protection or any purpose for which it is not designed.
Use suitable restraint methods, quantities, positions and edge protection for the specific load.
Ensure operators are appropriately trained and comply with workplace, road transport and load-restraint requirements.
Website information and demonstrations are general information and do not replace a site-specific risk assessment, a load-restraint engineer’s advice, manufacturer instructions or legal obligations.
9. Returns, refunds and consumer guarantees
Our Refunds & Returns Policy forms part of these terms. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law where it applies. Nothing in these terms limits a remedy that cannot legally be limited.
10. Website availability and permitted use
You may use this website for lawful personal or business purchasing and information purposes. You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with security or availability, scrape content, impersonate another person or use the website to infringe another party’s rights.
We may suspend or change website functions for maintenance, security, operational or legal reasons. We do not promise uninterrupted or error-free access.
11. Intellectual property
The Race Reels® name, branding, product designs, photographs, videos, text, graphics and other website content are owned by or licensed to us and are protected by intellectual property laws. You may view and print reasonable extracts for evaluating or using our products. You must not reproduce, modify, distribute, commercially exploit or falsely associate our content or branding without written permission.
12. Reviews, enquiries and material you submit
Information you submit must be accurate, lawful and not infringe another person’s rights. If you provide a review, testimonial, photograph or video for publication, we will obtain the permission required to use it and may edit it for length or clarity without changing its meaning.
13. Third-party services and links
The website may use or link to third-party services, including Shopify, payment providers, couriers, maps, video hosts, analytics and social platforms. Third parties operate under their own terms and privacy policies. We are not responsible for a third-party website or service outside our reasonable control, but this does not affect any responsibility we have under applicable law.
14. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by misuse, unauthorised modification, failure to follow instructions, unsuitable equipment selection, ordinary wear, or circumstances outside our reasonable control.
This limitation does not apply to liability that cannot lawfully be excluded or limited, including applicable consumer guarantees, liability for our negligence where it cannot be excluded, or any other non-excludable right or remedy.
15. Privacy
Our Privacy Policy explains how we collect, use, disclose and protect personal information and forms part of these terms.
16. Changes to these terms
We may update these terms from time to time. The version published when an order is placed will apply to that order unless a change is required by law or agreed with you. The current effective date appears at the top of this page.
17. General
If part of these terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remaining terms continue. A delay in enforcing a right is not a waiver of that right.
18. Governing law
These terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and courts entitled to hear appeals from them, subject to any rights you have to bring a claim in another jurisdiction under applicable law.
